FansHeaven DMCA Takedown Policy

FansHeaven is committed to protecting the intellectual property rights of creators and copyright owners. We comply with the Digital Millennium Copyright Act (DMCA) and provide a process for copyright holders to report content that may infringe on their rights. This DMCA Takedown Policy outlines the procedures for submitting a copyright infringement notice and how we respond to such notices.

1. Reporting Copyright Infringement
If you believe that content on FansHeaven infringes your copyright, you may submit a written notice to our Designated Copyright Agent. Your notice must include the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed (e.g., a URL to the original work or a detailed description).
  • Identification of the material that is claimed to be infringing, including its location on FansHeaven (e.g., a URL to the specific content).
  • Your contact information, including your name, address, phone number, and email address.
  • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner’s behalf.

 

2. Submitting a DMCA Notice

3. Response to DMCA Notices
Upon receiving a valid DMCA notice, FansHeaven will take the following actions:

  • Promptly remove or disable access to the allegedly infringing content.
  • Notify the creator who posted the content of the removal and provide them with a copy of the DMCA notice.
  • In cases of repeat infringement, we reserve the right to terminate the account of the creator in question, in accordance with our Terms of Service.

 

4. Counter-Notification
If you believe that your content was removed in error, you may submit a counter-notification to our Designated Copyright Agent. Your counter-notification must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled, including its location on FansHeaven before removal.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.
  • Your name, address, phone number, and a statement that you consent to the jurisdiction of the federal court in [Your Jurisdiction, e.g., São Paulo, Brazil], and that you will accept service of process from the person who submitted the original DMCA notice.

Upon receiving a valid counter-notification, we may restore the content within 10-14 business days, unless the original complainant notifies us of a legal action seeking to keep the content removed.

5. Creator Responsibility
Creators on FansHeaven are legally responsible for all content they upload, including content featuring other individuals (“Co-Authored Content”). By uploading content, you warrant that:

  • You own the rights to the content or have obtained all necessary permissions to share it on FansHeaven.
  • For Co-Authored Content, each individual featured is either a registered creator on FansHeaven or at least 18 years of age, with documented consent to share the content on our platform.
    Failure to comply with these requirements may result in the removal of the content, account suspension, or withholding of earnings, at FansHeaven’s discretion.
